Draft — not in force. The operator’s details are not filled in, so this document names nobody and binds nobody. Set LEGAL_NAME, LEGAL_TAX_ID, LEGAL_ADDRESS and LEGAL_CONTACT_EMAIL before taking any money. A production server refuses to start until you do.
These terms govern your use of Attention Market. By creating an account you accept them. If you do not accept them, do not create an account.
1. What the service is
Attention Market is a public leaderboard of projects. Position on it is determined by money bid, and by nothing else. Anyone may list a project without paying; paying moves it up.
A bid buys a position on this board, for as long as nobody bids more. It does not buy a period of time, a number of visitors, a level of exposure, a business result, or any endorsement of your project. Your position can be taken at any moment, including immediately after you pay.
2. Accounts
- You must be at least 18 years old and legally able to enter into a contract.
- The details you give must be accurate, and you are responsible for everything done through your account. Keep your password to yourself and tell us if you think someone else has it.
- One person or organisation, one account. Accounts created to bid against yourself and inflate prices are not allowed.
3. Projects you submit
You keep ownership of what you submit. By submitting it you give us permission to display it on the site and to use its name and description to promote the board. You confirm that you have the right to do this.
You must not submit a project that:
- is illegal, or promotes something illegal;
- infringes someone else’s rights, including trade marks;
- impersonates another project, person or organisation, or is misleading about who is behind it;
- contains malware, or links to a site that does;
- is a scam, or a financial offer of any kind that is not authorised where its audience lives.
We may remove a project that breaks these rules, or that we reasonably believe does. Where we remove one, we will tell the account holder why and refund the settled bids on it. Removal for a good reason does not entitle anyone to compensation beyond that refund.
4. Bidding and payment
- Amounts are in euro and are shown inclusive of any tax that applies. What the checkout shows is what is charged.
- The minimum bid is €1 above the bid you are beating — never the difference between them.
- Payment is taken through Stripe. We never see or store your card details. Stripe processes them under its own terms.
- A bid takes effect when the payment settles, not when the checkout opens. If a payment fails or is abandoned, nothing changes and nothing is owed.
- A bid is not a deposit or a balance. There is no account credit, and money paid is not transferable to another project.

5. The ranking
How position is determined is set out in full on the ranking transparency page. In short: the highest settled bid ranks highest, ties are broken by whoever got there first, and refunded bids stop counting.
We may correct the ranking where a bid was placed fraudulently, was charged back, or resulted from a fault in the service. Where a correction moves your project down, the affected bid is refunded.
6. Availability
We try to keep the service running and correct, but we do not promise that it will be uninterrupted or error-free. We may change or suspend parts of it, and we will give reasonable notice before a change that materially affects positions already paid for.
If the service is unavailable for an extended period while you hold a paid position, contact us and we will refund the affected bid in proportion to what was lost.
7. Ending the agreement
You can close your account at any time. Closing it does not automatically refund bids already settled; the refunds policy says when a refund is due.
We may suspend or close an account that breaks these terms. Where the breach is not serious, we will ask you to put it right first.
8. Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law — including your rights as a consumer, which these terms do not affect.
Subject to that, our total liability to you in connection with the service is limited to the amount you paid us in the twelve months before the claim arose. We are not liable for lost profits, lost business or lost opportunity arising from a position not achieved or not held.
9. Changes to these terms
We may update these terms. Each version carries a version number and a date, both shown at the top of this page. If a change materially affects your rights we will tell account holders before it takes effect, and continuing to use the service after that date means accepting the new version.
10. Law and disputes
These terms are governed by the law of Spain. If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and you may bring proceedings there.
If something goes wrong, write to us first — most things are settled that way. Consumers in the European Union may also use the Commission’s online dispute resolution platform.
